  • Services mean electronic services within the meaning of the Act of 18 July 2002 on provision of services by electronic means (consolidated text, Polish Journal of Laws of 2017, item 1219) provided by Mirumee available on the Website and on websites, which are linked on the Website
  • Terms mean these Terms of Service governing access of Users to the Website and use of the Website
  • User or Users means/mean Users visiting and using the Website
  • Website means website available at mirumee.com

PRIVACY POLICY

  1. Who is the data controller?

    2. The data controller responsible for processing your personal data is Mirumee. You can contact us via the email address:privacy@mirumee.com or on the postal address indicated above.

  2. What type of personal data and other information we collect and process?

    3. While using the Website we do not process User’s personal data, unless Users voluntarily submit such data to us (e.g. by using the contact form, contacting us via social media, signing up to get updates). In case of submitting information by the User we may process personal data such as first name, name, e-mail, company’s name, social media profile, IP address, etc.

    We collect and process solely data regarding the User’s visit on the Website, including data stored in the cookies, such as length of the stay on the Website, User’s behavior on the Website etc.

  3. Purposes and the legal basis for the processing of personal data

Depending on the content of the personal data submitted by the User such data are processed by us for the performance of a contract or in order to take steps prior to entering into a contract (legal basis: Article 6(1)(b) of the GDPR) or for maintaining contact and relationships with clients or potential clients based on our legitimate interests as data controller (legal basis: Article 6(1)(f) of the GDPR).

    If the User submits his/her e-mail address to sign up to get updates, this affirmative action signifies agreement to sending of the above-mentioned information, which may include commercial information, and we process personal data to send newsletters with latest news concerning Mirumee (legal basis: Article 10 of the Act of 18 July 2002 on provision of services by electronic means in connection with Article 6(1)(f) of the GDPR).

    We process data regarding the User’s visit on the Website for the marketing and analytical purposes based on our legitimate interests as data controller (legal basis: Article 6(1)(f) of the GDPR). If the User is contacting us via our social media, we also may process his/her data to answer or respond to this activity and maintain relationships with Users interacting with us (legal basis: Article 6(1)(f) of the GDPR).

    Additionally we may process User’s data for the purposes of exercising or defending of legal claims (legal basis: Article 6(1)(f) of the GDPR).

    Data stored in the cookies are processed on the basis of consent according to Article 173(1) – (3) of the Polish Telecommunication Law of 16 July 2004. More information about cookies, including use of third-party cookies, can be found in the section Cookies.

    Data relating to the User’s (Client’s) customers and online shopping services may be processed by us under a separate agreement entered into with the User (Client).

    5. Your data may be transmitted to the entities cooperating with us, especially to companies providing IT-services (e.g. providers of hosting services) and providers of email marketing services (e.g. Mailchimp, ActiveCampaign).

  5. Transfer of personal data to a third country

    6. Due to the fact that we use services of other providers, e.g. the ICT services or email marketing services, User’s data may be transferred outside the European Economic Area. In this case, it will always be done in a way to ensure the adequate level of data protection, e.g. based on an agreement, which contains standard data protection clauses adopted by the European Commission or with companies which are certificated under the EU-U.S. PRIVACY SHIELD.

    7. You can contact us via our social media: Twitter, Facebook, Spectrum and GitHub.

    If the User is using our social media, his/her data might be transferred to the provider of the social media sites and processed as a separate data controller for the purposes related to the activities of the social networking platform. In this case the User’s data might be processed outside the European Economic Area (EEA), e.g. in the USA, where other data protection legislation applies and therefore, an adequate level of data protection may not be ensured.

    8. GDPR guarantees you a number of rights and to the extent provided by the law you have:

    • the right to know what data concerning you is held by any particular company and how it is processed;
    • the right to rectify any inaccurate personal data;
    • the right to be forgotten;
    • the right to restriction of processing;
    • the right to object to processing;
    • the right to data portability.

    Where the processing is based on Article 6(1)(a) of the GDPR or a consent granted on another legal basis you have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

    You also have the right to lodge a complaint with a competent supervisory authority, i.e. the President of the Polish Office for the Protection of Personal Data (Prezes Urzędu Ochrony Danych Osobowych).

COOKIES

We collect information contained in cookies and other technologies such as pixels.

Cookies are small text files that are stored on your computer when you visit our Website. Cookies help us to make our offers and our Website as comfortable and efficient as possible for the User. We use:

  • session cookies - these are cached exclusively for the duration of your use of our Website;
  • permanent cookies - these are stored in your terminal device for the time specified in the cookie files parameters or until you delete them.

We use the following analytics or advertising tools:

    • This Website includes Google Analytics software that collects anonymized information about visitors, in particular information from cookies, to help us provide better services.

  • Google Tag Manager

    • We use Google Tag Manager to manage tags on the Website, including measurement and marketing optimization tags.

  • Google Ads

    • Google Ads is an advertising platform, which helps us to create online ads to reach people interested in the products and services offered on the Website. The conversion tracking feature of Google Ads uses cookies.

  • Google Optimize

    • Google Optimize enables to run tests on the content of the Website to learn what works best for the Users and to customize the Website experience. Google Optimize uses additional cookies to e.g. determine a User's inclusion in a test.

  • HotJar

    We use Hotjar in order to better understand our Users’ needs and to optimize service and experience on the Website. Hotjar is a technology service that helps us better understand our users experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our Users’ behavior and their devices (in particular device’s IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user.   • Facebook Pixel and Facebook Ads

    Facebook Pixel collects data that helps track conversions from Facebook Ads, optimize ads, build targeted audiences for future ads, and remarket to Users who have already taken some kind of action on the Website.

  • Twitter Pixel

The above-mentioned analytics tools may use cookies (both first and third-party cookies) in order to collect and generate statistical information on the use of the Website and social networking sites. Data collected and processed in these tools are by default anonymous data.

TERMS AND CONDITIONS

General provisions

The Terms govern the Services available on the Website and on websites, on websites, which are linked on the Website, the rules for the access to the Website and provision of the Services by Mirumee.

By using the Website, the User declares that he/she has agreed to and accepts the Terms. By using the Services Mirumee and the User enter into an agreement on provision of electronic services, conditions of which have been set out in the Terms.

The Terms are available for the User on the Website for free at any time, in particular before entering into an agreement on provision of electronic services in accordance with the Terms (before using the Services). The User is also entitled to request making him/her the Terms available in such a manner that the terms may be obtained, displayed and recorded by the User.

    On the Website and on the websites, which are linked on the Website, Mirumee offers the following Services:

    3. For the proper use of the Services and the Website it is required to have a device with an internet connection and internet browser. We recommend using the following internet browsers: Google Chrome (version 69 or later), Firefox (version 63 or later), Opera, Safari or Microsoft Edge[*]. To achieve a better user experience we recommend enabling JavaScript and opt-in cookies.

  3. Contact form

    4. Within this Service the User may contact us, in particular for estimating a project. Providing Services by Mirumee starts with providing data via contact form and ends with sending of submitted information to Mirumee.

    For using the contact form no additional technical requirements have to be fulfilled, but the User has to submit information about the project and his or her contact data.

    Contact form may be used by any User for free.

  4. Complaints

    5. Any complaint regarding providing Services shall be made at hello@mirumee.com.

    In the e-mail concerning a complaint the User shall give as much information as possible about the case, especially describe the malfunction (e.g. date, type and form of malfunction, details of such malfunction), its impacts on the Services and contact details.

    We will try to handle any complaint as soon as possible, at least within 14 days from its receipt and contact the User using the previously provided contact data.

  5. Using the Website

    The Website is for information purposes only. By using the Website, the User may obtain information about Mirumee. Each User is entitled to use the Website for free.

    To use the Website, it is not required to register or fill in a form. However, some additional services with regard to Mirumee (e.g. filing in a contact form, registration, posting) may be offered on other websites, which are linked on the Website. By using these websites, the User may expect that some extra data has to be provided or some special requirements may be imposed. Notwithstanding the provisions of the Terms, to find more information about our services on the linked websites, the User shall visit these websites, read and follow the terms of services available on these websites.

    The User is obliged to use the Website in accordance with the Terms, applicable law, principles of community life, good practices, especially rules followed by the Internet users (netiquette). In particular, the User is not entitled to:

    • provide unlawful content,
    • any actions that could impede or disrupt the operation of the Website,
    • any unlawful actions regarding the use of the Website,
    • any actions that could infringe privacy of other Users,
    • any activities that violate or may violate the good reputation of Mirumee,
    • any actions that might be considered as conflicting with the Terms or the purpose of the Services.

    If the User violates the Terms set out above, we have the right to take any legal action resulting in claiming compensation.

    7. We seek to ensure the quality of the Services on the Website, but we cannot guarantee that the Website and the content on the Website will be available uninterrupted and with no breakdowns. Our Website includes links to other websites, which (in case of some of them) are not governed by us. We do not take responsibility for the availability of these websites. To the services available on these websites separate terms of services shall apply and we encourage the Users to get to know them before using these websites.

Costs of the Services

Using the Website is free.

Only if the User decides to use some other services related to Mirumee and provided by Mirumee (e.g. customizing, extra code), some additional costs may occur.

Copyrights, intellectual property rights, know-how

All content, graphics, logos, interface, pictures and other materials available on the Website are protected by copyrights or intellectual property rights.

The User is entitled to use the content of the Website for private use and inform other persons about our Website provided that the source of the information (Website address) shall be identified. Any commercial use of the materials on the Website requires prior consent of Mirumee or obtaining a license form Mirumee.

It is forbidden to duplicate, reproduce or modify materials available on the Website, irrespective of the form of these materials (e.g. in paper or digital form).

On the Website we may show examples of Mirumee’s projects, but we always take care to get an appropriate consent from our Clients to use those images. Therefore, the above mentioned restrictions concerning use of the materials on the Website shall also apply to those photos.

MISCELLANEOUS

Governing Law

These Terms shall be governed in accordance with the laws of Poland. These Terms will not limit any consumer protection rights arising from the applicable mandatory law.

Amendments

We may at any time change the Terms by publishing the amended Terms on the Website or by otherwise notifying the Users of the amended Terms. The User is obliged to monitor the Website to ensure he or she is aware of any changes in the Terms.
